Please read these Terms & Conditions (“Terms”) carefully before using the website swissmotorhouse.com (the “Site”) or engaging Swiss Motor House to source, import, or sell a vehicle. By using the Site or placing an order with us, you agree to be bound by these Terms.
Scope
These Terms apply to all use of the Site and to all quotes, orders, and sales of vehicles and related services (import, registration assistance, financing referral, etc.) carried out through Swiss Motor House, unless a specific written agreement between you and us expressly provides otherwise.
Vehicle Listings and Information
Vehicles presented on the Site (new or used, in stock or available to order) are described as accurately as possible, based on information provided by manufacturers, suppliers, or previous owners. Photos are for illustration and may not represent the exact vehicle, colour, or configuration.
Availability, specifications, and prices are subject to change without notice until a written quote or order confirmation has been issued.
We reserve the right to correct any descriptive, pricing, or typographical errors on the Site at any time, including after an order has been placed, in which case we will inform you promptly and you may withdraw your order free of charge.
Requests, Quotes, and Orders
A request submitted via the Site (contact form, quote request) does not constitute a binding order; it is a request for information or a personalised quote.
A binding order exists only once you have signed or otherwise formally accepted a written quote/order confirmation issued by Swiss Motor House, specifying the vehicle, configuration, price, and estimated delivery timeframe.
Estimated delivery timeframes are provided in good faith based on information from manufacturers and suppliers and are not guaranteed; they may vary due to production, shipping, or customs circumstances beyond our control.
Delivery, Import, and Registration
Vehicles are delivered “ready to drive” with Swiss registration plates, unless otherwise agreed.
Unless your order confirmation states otherwise, Swiss Motor House handles the import, customs clearance, and registration formalities on your behalf; you agree to promptly provide any document reasonably required for these formalities (proof of identity, driving licence, proof of address, etc). Title passes upon full payment of the price.
Cancellation and Right of Withdrawal
Because vehicles are frequently imported or configured to order, Swiss law does not provide a general statutory “cooling-off” right of withdrawal for this type of purchase.
If you wish to cancel a confirmed order, please contact us as soon as possible. Depending on how far the order has progressed (e.g., whether the vehicle has already been purchased from the manufacturer/supplier or is in transit), we may retain all or part of the deposit to cover costs and losses already incurred. The applicable cancellation terms will be set out in your order confirmation.
Warranty
New vehicles benefit from the manufacturer’s warranty, valid across the official service network in Switzerland and Europe, in accordance with the warranty booklet supplied with the vehicle.
Used vehicles are sold with the warranty (if any) specified in the order confirmation or sales contract; where no specific warranty is stated, statutory warranty rules under the Swiss Code of Obligations apply.
The warranty does not cover damage resulting from normal wear and tear, misuse, lack of maintenance, or unauthorised modification of the vehicle.
Extended warranty products, where offered, are governed by the terms of the relevant provider.
Trade-In Vehicles
If you wish to trade in your current vehicle as part of a purchase, its valuation is indicative until physically inspected by us. The final trade-in value will be confirmed in writing and may differ from an initial online or verbal estimate based on the vehicle’s actual condition, mileage, and documentation.
Financing and Leasing
Where we refer you to a financing or leasing partner, any financing or leasing agreement is entered into directly between you and that third-party provider and is subject to its own terms, conditions, and credit approval. Swiss Motor House acts only as an intermediary and is not a party to that agreement.
Liabilitiy
We are liable for damage caused intentionally or through gross negligence, in accordance with Swiss law. To the extent permitted by law, our liability for slight or ordinary negligence is excluded.
We are not liable for delays or failures to perform caused by events beyond our reasonable control (force majeure), including manufacturer production delays, customs or regulatory changes, or transport disruptions.
Nothing in these Terms limits any liability that cannot be excluded under mandatory Swiss law.
